Nmesis's Journal
Give the Honorable James (Jiminy) A. Doerty a break because he has received so much negative publicity since his rulings (17 Jun 02) and (21 Jun 02). Between reading his email messages, and having hissy fits over the personal abuse contained in them, he has had no time to reflect on the injustice that he has caused. Readers may send new messages to Doerty for publication in Jiminy's Journal.
Doerty jailed Nmesis for 111 days, twenty-five days in solitary confinement, without reasonable cause. Now he has the audacity to say on the court record that: "He [Trummel] can never repair the damage. This has cost the taxpayers in this county, I am sure, about $30,000 just to house him in jail and process him here in court".
Reportedly, several Seattle attorneys who have appeared before Doerty have variously described him as "running amok", "out-of-control", "unstable", "vicious", and "evil" - that sounds reasonably accurate. Another Seattle lawyer, who claims to have appeared before him many times, says: "He does not strike one as having both oars in the water".
Now Doerty has threatened to jail Nmesis for stalking, a felony that would allow him to instruct the US Immigration and Naturalization Service (INS) to initiate deportation proceedings. Doerty presents no evidence. He does not explain how Nmesis can stalk little old ladies with dogs while in jail. In all probability, Nmesis will use the defense that he stalked the dogs not the little old ladies. Then Doerty can indulge in some ass-sniffing during the discovery process.
Another gem from his finding refers to the email that he has received about the case. He says that it contains his "personal favorite": "Your law school ought to refund your tuition money". He did not realize that the writer did not joke. He goes on to say that: ". . . there's a lot of shrill invective from self-described investigative journalists, who scurried to defend a perceived frontal assault on free speech without, ironically, doing any sort of investigating before mouthing off". This from a judge who mouths off then enters into the court record material that he has randomly picked from the Internet to compensate for a dearth of hard evidence. Go to Doerty's findings (17 Jun 02) and (21 Jun 02) if you find these statements incredible then judge them for yourself. The Seattle attorneys did not exaggerate.
Doerty says that he will send Nmesis to a European Union (EU) country if he continues to publish public information that Jiminy finds embarrassing to Council House, his "clients". He claims EU judges have less patience with recalcitrant web spinners and stricter Internet laws. Perhaps he means the Soviet Union - the Gulag Archipelago.
Please maintain proper respect for the judiciary despite a recent motion calling for Doerty's recusal. Disregard his remark from the bench when, with a conspicuous leer, he described dissidents as "cyber-creeps". Those dissidents inundated his web site with so many negative comments about his abysmal ignorance of First Amendment rights, and his recent decision to incarcerate Nmesis, that he deleted his guest book. Those guest book messages now appear as Jiminy's Journal.
C. G. Jung's associate, Jolande Jacobi, probably got it right when she wrote: "For the type of man who is intellectually developed but has remained affectively and emotionally a boy is a widespread phenomenon which is characteristic of our epoch, and which perhaps is connected with the emancipation of women in the twentieth century. . . . [that could have] unwittingly prevented the development of the masculine ego to full responsibility. The man who remains fixated on the level of a pubescent, not infrequently has homosexual leanings, and remains a puer aeternus, an infantile adult, for the rest of his life. Alarming indeed, since often, if he holds an official position, he holds the fate of the world in his hands."(1)
Give Doerty the respect that his position deserves. Fear his tyrannical power. Ignore the fact that he tramples the constitutional rights of others. Remember, what your mother told you: "If you cannot say something nice about somebody else then don't say anything at all. "That's the American (politically correct) way and as basic as apple pie to real Americans.
Write to Jiminy's Journal to say something about Jiminy that will persuade voters not to reelect him. Who knows, you may positively affect the fate of the world that Doerty holds in his hands.

As a retired member of the National Union of Journalists I receive the Freelance Newsletter.
Before joining the NUJ I was a nurse and over my life I saw some things that were wrong but never anything like described on the web site.
I believe a free press is necessary to protect the freedoms of the most vulnerable and that means we need men and women of integrity to stand against evil whenever they see it and whatever the cost.

Sadly, this simply reinforces my own point of view. Namely that freedom and justice have never been comfortable bedmates and I believe that they never will be. The only true freedom that a man or woman has is inside their own heads and hearts.
Legal 'Justice' is purely a form of public control by the powers that be. You will get 'justice' if they want you to have it. You will only get what is in their interests to give you, nothing less, nothing more.
This is the way of the world and it saddens me that we continue to raise our children in the belief that we live in a free and democratic society when the reality is so very different, dependant on who you are.
The evil people that you write about will feel the effect of the law if and /or when the powers that be decide that it will be good for their own public image to do so. They will become sacrificial lambs to the slaughter in order to help authority reinforce the idea that corruption and vice are not a part of the system, and that justice is safe in their hands.
I wish you well my friend but I fear for you. When it suits them, you will be sacrificed in the same way, and the rest of the world will forget about you with a speed that should shame them, but probably won't.
I would like to take this opportunity to wish you and your loved ones all the very best of good health and good fortune during 2003. May your strength and your courage not desert you in the long struggles yet to come.

No one ever answered (including NWU).
I am a freelance writer whose work is sometimes very contentious. Who is he to say that I do not have First Amendment rights because I work for myself and not for a "job." That is ridiculous.
Please write about what has happened to you and what is in the cards now.

I've got an Order against me (as Paul had), and have been ordered to come from my home in Greece and go to Scotland, to stand before the Judge and answer why I have not removed the site... This is of course unlawful of the judge to require . . .

Juneau, Alaska. English Lord Acton once said "if power corrupts then absolute power corrupts absolutely". Jefferson said something to the effect, "speech limited is speech lost" and Voltaire said: "I may not like what you stand for but I shall defend your right to think it, speak it, and write it with my life" Judges in the United States have become a cult of their own-black robes and all - and the U.S. Constitution and people be damned! Judge Doerty should be made into a eunich to prevent any possibility of procreation. To jail a man for free speech and expression is an absolute tragedy!!!! Crimes are committed every day whereby the perpetrators receive probation, but dare someone stand up to the power or cult of the robe and a Judge can jail an innocent man who has not committed any crime, to jail in the name of civil contempt. I have nothing but contempt for Judge Doerty and that intellectually deficient prima donna should ! be jailed by the Appellate Court for a year. But that can never occur since the appellate judges belong to the same brotherhood and cult of the robe and besides, normally only the rich can afford appeals. I find nothing but contempt for Judge Doerty, i.e., critical and provocative speech is protected under the First Amendment. I praise Mr. Trummel for standing up for his rights even though he was unjustly jailed for doing so. The U.S. Judicial system is corrupt, judges possess far too much power, and the judiciary is in bad need of reform and Judge Doerty only confirms this position. Good Luck to Mr. Trummel.

Today I was "professionally" reprimanded by my publisher for disseminating interoffice information about the 9th Circuit Court of Appeals' ruling that the words "under God" in the Pledge of Allegiance were an unconstitutional "endorsement of religion." While I was excoriated for reminding my co-workers that the Constitution endorses a separation of church and state, I immediately thought of you and your plight. Your legal case is reaching critical mass. Remember that all journalists recognize the absurdity of your case. Stay strong as you present your case. As you know, determining legal innocence takes much longer than publishing truth.

Let me say that I am very sorry to hear that the court has censored your legitimate use of free speech. I did not hear of your site until I saw mention of the turmoil surrounding at at [URL omitted to comply with court order], so I unfortunately never saw what your page had to offer. There is some bitter irony in the fact that an important informative site only came to the attention of most people when the information was removed. You have my condolences that you have been obligated to take the pages down, but I do hope that others have copied the contents of the site to their own personal storage places where the information can stay secret & untouched until a better medium of free speech comes along. I have not read your little notice carefully yet, but I have a general observation to make about our court system. In general, a defendant is not allowed to defend himself in our court system these days. That seems to give government ultimate power to control society - social control - (National/International Socialism). The problem for them is that there IS a price to be paid for all that usurpation of "power." The price is that this government and its courts can no longer "convict" anyone -- since conviction can come only after someone has defended himself. There can be no "conviction" until both sides have been heard! What these "pseudo-courts" have gained is the power to "socially condemn" the accused in a public way -- what they have lost is their ability to convict. Social condemnation is not conviction.Any court that has no ability to convict is unworthy of respect. It's judges are personally unworthy of respect as were the socialist NAZI or Soviet judges in a previous time! Perhaps the last non-violent thing the American people can do to regain a measure of control over those who have overthrown our legitimate government is to aggressively confront those who do not operate under law. Point out that they are not worthy of respect because they are not operating under law, so of necessity must be operating in violation of law. As you probably know, the root of all their assumed power is fraudulent -- all that flows from fraud is fraudulent -- fraud may never be law under any circumstances so what they are doing could never to be considered law! Unless, of course, they intend to contest or consolidate these usurpations with the force of arms . . .

In today''s climate, each of our basic rights guaranteed under the U.S. Constitution and its Amendments are constantly being eroded by the government and its agents in its quest to grab the power from the citizenry. We have a President who was appointed by a Court with questionable legal authority. We have United States citizens imprisoned incommunicado by the United States Government and being denied their constitutional rights of counsel, speedy trial, right to face accusers, etc. It is proper to question the Government and any programs that exist on the public tit. Simply reporting the activities and abuses of these programs that you and I pay for should be allowed to go on without the threat of incarceration by totalitarian judges and other officials. I guess the era of a constitutional republic has officially come to an end. We have seen Atty Gen Ashcroft and Pres Bush the immature have systematically dismantled civil rights in this country in the name of War on Terrorism. The fact is that our government has become the terrorists. The are attempting to control us with an oppressive fascist strong hold. This may seem like a simple battle, but this is the type of issue that could mean the end of all civil rights in this country.

While I do not know the details of the case and have only recently become aware of it, I do believe that the judicial system has committed a grave error. While I do not agree with your decision to post personal information about persons employed at the institution, you are well within your rights to post your opinion about anyone. If there is disagreement then the freedom to publish those differing opinions is available. Publishing the contact information at the administrative offices would have been a far wiser move. If THAT was censored then your rights were not just ignored, but purposefully trampled. Information available to the general public in regards to establishments funded by federal funds should be available regardless of the situation. Even the CIA and other intelligence agencies have public information access! Is it to be assumed that the "health care" facility you originally published about is to be considered more of a security concern than the FBI or the CIA?? Insanity. I have had huge running debates and arguments with numerous people, both in person and over the internet. The wonderful thing is that we ARE free to debate and have opinions which differ widely from each other. The fear i have is that cases like yours will become more and more common - Where freedom of speech and thought are placed secondary to the financial stability of a institution. I wish you the best of luck in your struggle. I stand as one American who will live by the words of Voltaire, "I disapprove of what you say, but I will defend to the death your right to say it."

(I confessed to the same crime, noting that even though I am American-born I was mistaken my understanding of federalism, in the notion that the First Amendment applied against state action, on account of incorporation into the Fourteenth Amendment.) Sorry to have gotten into this late; the CNN article earlier this week was the first I heard of the matter. I'm surprised it's not being screamed about on Usenet and the usual northeast mailing lists and traditional news outlets. (I usually hear about such things from Libertarian Party mailings, or as off-topic notes in 2nd Amendment mailings, or general rants. My wife was formerly ALA, but we don't participate actively.) Family Court Commissioners get used to the idea that they can ignore facts, law, and Constitution as long as their arbitrary decisions do not offend the politically correct crowd. So I bet Judge Doerty is a bit surprised at the reaction he got when he tried the same crap in a case outside of family law and even more outside the First Amendment. But we really got to pound on the judiciary's treatment of family law and the combination of big government liberal and social conservative attitudes that run contrary to what the United States is all about. The reason is that the "legitimate interest of government excuse" is the true threat to our freedoms. It's what allowed the courts to uphold the internment of persons of Japanese ancestry during the war, to imprison American citizens indefinitely without trial since September 11, 2001, and that cesspool we call family law. I have no idea what your complaint is, or, for that matter, who you are.
However, the fact that, according to what I have read, you are being forced to curb your right to free speech on the Internet is an outrage. I am simply staggered a judge would not only hand down such a ruling, but would incarcerate you for exercising your right to free speech. We are, it seems, living in a new, and not terribly attractive, age. I wish you luck.

I understand your predicament better than most, having had adversity because of my publications, and admire your courage in the face of this attack against your rights as a journalist. Fact is, until the USA, anyone who spoke publicly in an attempt to brings facts to the public when those facts were not welcomed by the lords of the manor, faced risk to limb and life. Now that the USA has devolved to a new fiefdom, it is not surprising that serious journalists like yourself would be the first to feel the fangs of the beast. I am writing to thank you for great website and your inspiring efforts to expose injustice and the blatant abuse/misuse of power in specific parts of our society. It is a most honorable and worthy cause, as you know, and one that has unfortunately resulted in several attempts to discredit and relieve you of your constitutional freedoms and past good deeds/credentials. However, as you know, this sort of abuse is common place in this society and therefore it takes much personal courage and sacrifice to speak the truth. "Shoot the messenger" is the prime directive for those who refuse to take responsibility for their creations but instead embrace the darkness of ignorant, selfish, mean spirited and hurtful behaviors and attitudes. I am sure you have read Noam Chomsky and also seen how our those in power use very sophisticated methods to control and brainwash others. What has happened to you and is typical because you are exposing the shadow side of several individuals who are in denial and/or are abusing the public trust. Naturally they will do whatever they can do to silence your voice and invalidate your reporting/editorializing. Keep exposing the abuse and injustice wherever it appears and eventually your work will inspire more people to awaken from their hypnotic stupor and "smell the coffee". This so called Judge is a disgrace to honorable judges and his depraved rantings/rulings are, without a doubt, politically motivated. However, he is making you into a martyr which in time may serve your cause. In the meantime be very careful and watch your back because many of the individuals you are reporting on may not play by the rules. Many good people have been hurt, silenced and even terminated/murdered for exposing and challenging those in authority who exhibit little or no respect for law, basic human rights and constitutional freedoms. When a court of any jurisdiction denies freedom of the press, it hurts anyone and everyone who calls themselves an American. What is next ? A county court in Alabama outlawing every religious website except one that publishes a Baptist message? That Judge in your state needs to: A. Get a life. B. Check out Title 18 Section 1980 Or is it 28 section 1980 ( Depravation of rights under color of Law) "Meaning you can have this judge arrested!!!!!!!!!!!!! " "Also have him/her removed from the bench for judicial misconduct." C. Realize that contempt is a Quasi-crime (as determined by the US Supreme Court, www.ancpr.org ) ( look in case law section) and subject to all protections of a individual suspected of committing a felony such as drug dealing , etc. Meaning you by LAW can demand a trial. Due to the fact that the contempt was supposedly committed against him/her he/she cannot preside over such trail. Good Luck and dont give up the fight .

Although I think it would have been more appropriate for Trummel to have provided the information regarding the Board of Directors and so on to HUD, residents with complaints, and the state (rather than publishing on the website), I don't see that he has done anything illegal by doing so. Although future laws (privacy-oriented) may prohibit such public disclosures, no law currently restricts it, so the primary case against Trummel is without merit. However, the reason he is in prison is because he failed to comply with the injunction made by the judge to remove the information from the website. I am not familiar with the law governing temporary injunctions and such, but it would seem to me that unless and until an activity is determined to be illegal, the court should have no business restricting it. I have heard of exceptions, though, and they all seem to apply to business practices, not the free expression of individuals. (e.g. injunction against Microsoft to stop shipping Windows 95 with Internet Explorer until determination of legality/illegality could be made). In any event, there is ABSOLUTELY NO JUSTIFICATION for him being in solitary! [Editorial Note: HUD, State of Washington, and City of Seattle, received repeated complaints before web publication. They have continued to ignore them which has allegedly contributed to at least two resident deaths.]
